Terms and Conditions

1. Role of the Agency

Wendy Adventures LLC (the "Agency") acts strictly as a sales agent for disclosed principal travel suppliers, cruise lines, hotels, airlines, and tour operators (collectively, "Suppliers"). The Agency does not own, manage, control, or operate any of these transportation vehicles, accommodations, or tour services. All bookings are made subject to the specific terms, conditions, and limitations imposed by these third-party Suppliers.  

2. Client Responsibility & Travel Documentation

The Client assumes full responsibility for verifying that all traveler names, dates of birth, and travel details exactly match their official, government-issued passports before any bookings are finalized. The Client must maintain a passport that is valid for at least six (6) months beyond their intended return travel date and is solely responsible for obtaining any required visas, entry permits, or health vaccinations necessary for the destination. Any rebooking fees or penalties resulting from client spelling or date errors are the sole responsibility of the Client.

3. Pricing, Deposits, and Cancellations

All quotes are subject to availability and supplier price fluctuations until a deposit is applied. In the event of a typographical error or price mistake by a Supplier, the Agency reserves the right to correct the error or cancel the booking on behalf of the client. All supplier deposits and payments are subject to the strict, non-refundable cancellation schedules of the independent Suppliers. Late payments or missing a scheduled milestone payment may result in automatic cancellation of the booking by the Supplier, subject to full forfeit of all funds paid to date.

4. Limitation of Liability

Because the Agency has no control over the personnel, equipment, or operations of independent Suppliers, the Client agrees that the Agency is not liable for any personal injury, property damage, financial loss, delay, inconvenience, or change in itinerary caused by:  

  • Supplier operational defaults, bankruptcies, or financial distress.  

  • Acts of God, weather anomalies, strikes, civil unrest, or government restrictions.  

  • Overbookings, flight cancellations, or schedule changes.  

5. Travel Insurance Waiver

Travel insurance is highly recommended to protect your vacation investment against unforeseen trip delays, cancellations, medical emergencies, or baggage losses. By declining or failing to purchase adequate coverage, the Client acknowledges they assume full financial responsibility for any out-of-pocket losses or cancellation penalties incurred.  

6. Claims, Disputes, and Governing Law

The Client agrees to first bring any complaints or issues regarding a trip to the Agency's attention while traveling to allow an immediate opportunity to attempt to rectify the situation with the Supplier. Any legal disputes arising under this agreement shall be governed by the laws of the State of Florida and resolved exclusively in Florida state courts.
